First - sorry to be a doubting Thomas! :P I'd asked this question on chat a few times over the weekend and got similar answers each time, but there is something that doesn't seem quite right happening in some battles I've fought.
It happens like this. I fight a battle, and lose. Within a second or so, I decide to fight a second time to try and finish them off. Yet, when I do so, the comatose opponent screen comes up. Now, I appreciate that it is possible that some other player could have come along and fought them before my second click, but by now this has happened over a dozen times or more...
My theory / question: imagine a team that has a familiar minion in it. I attack, and kill all the minions except the familiar, which by itself is powerful enough to defeat my team. Technically, wouldn't the opponent team be comatose then, after their familiar disappears back into whatever dimension it came from?
I hadn't been keeping track til now, but the last time this phenomenon occurred it was indeed to a team using a ToJ.

Perhaps you could take a look at the battles fought by your opponent at that time to see if someone else attacked him. Otherwise it seems an interesting idea. I've seen weirder bugs in my life. :)

you are correct, familiars only appear if the minion equipping it is alive at the start of the battle.

Ok, thanks for the response Jon :) As long as I know this is the case that's fine, it was just niggling at me.
Ahh... So that's the answer...
it's been buggin me to... :S I think the familiar should still have to come back and fight darn it!
Good way to make it so you never lose a battler though. ;)

It was a little tricky but I should have it now so the familiar comes back with the HP it has from the last battle.
