Sometimes I get 9 BA per 10 min and sometimes I get 8 anyone know why?

If you use another one of your characters to buy/sell/rent, if you train farmed BA, or if another character is the active one when the 10 minutes BA gen time arrives, then you will only get 8 BA.
Also, I noticed that I only get 9 BA if I have 0 BA left. If I have any BA left, I get only 8 BA per 10 minutes.
It's probably most likely that you're on the cusp of 45% of Sut's MPR. As he widens the gap, you gain more BA. As you narrow the gap, you gain less.
