Clanmate CM ban problem? (in General)

I have to admit, I'm getting a little annoyed. And it's about Chat Mail. I guess I let little things bother me sometimes. But here's the deal. My clanmate, whom I'll leave unnamed, claims he has been CM banned. Or he can't get them to work. I'm not sure what his exact story is, he's kind of dodgy about it.

So here's my problem: he claims it's permanent. And since he can't send CM out, he now uses the Clan CM system to tell us to tell others to do his deals and talk to us. This pretty much seems like spam to me. I'm getting kind of tired of it really.

My questions:
1. What can be done?
2. Is there actually such a thing as CM banned? (I'm not even sure it exists)
3. Could an admin perhaps consider giving him another chance?
4. Doesn't this seem like a cheat against a CM ban, if that is the case? If he can't send out CM's, should he be still able to indirectly?
5. And does a /ignore perhaps filter out his CM too?

Can't that player post for him/her self, or is there also a forum ban?

1: Hmmm, person could be booted, but would be unfriendly.
2: Yes, I think that any person being 48!'ed is also being chat mail banned, most likely to prevent the things the chat ban was given for also.
3: Perhaps but the person has to ask the admin who made the ban...
4: Clan chat mails are treated differently I think.
5: /ignore should ignore chat mails also yes, i think... (try this with another player you trust to check if it works)

doesnt say anything on there about CM's on his "Silencing"

The real question should be what did he do to get banned if I can't trust the people I work with I would can him.

I've applied chatmail bans to "clan mail" too.
