This is Boloney (in Public Record)

Flames Fame December 29 2006 12:47 PM EST

<Kong_Ming> [mail:] Yes but you have to understand that I'm paying you with my pair of AG which we have agree for a price of 1.6 million. 1.6 million in itself would require you to forge 2.28 million in nw for me. So asking me to pay another 353k is equivilant to asking me to pay 1.953 million for your service so I'll expect 2.79 million nw increase instead.
<Kong_Ming> [mail:] Also, I'll send the rest of the payment as and when you require up to 353k.
<Kong_Ming> [mail:] Lastly, the MgS job is only about 1.8 million nw increase so you own me another 1 million job.

If you read my post in Forging services and look under the terms and conditions you will understand that 353K is about 20% of the total 1.8M. But asking me to forge instead of 1.8, 2.79M NW for requiring 353K for the BS fees, is wrong.

The 353K should be forged for as a loan. not adding 990K to the total is not proper, and i consider this a type of scam.

Admins please look into this for me.

AdminShade December 29 2006 12:55 PM EST

Can we also see your Chat Mails please, and the original 'agreement'?

bartjan December 29 2006 12:58 PM EST

If I could understand the above, I would look into it.

Where's the original Public Record thread?

Usually when you forge for someone you send 20% up front like what is required in my post if you would have read the contract. All parties are binded by this contract.

To: Kong Ming Sent: 5:05 AM EST Delivered: 6:45 AM EST
i don't have 350K to throw away on a forge, all i'm requiring is that amount that you would have to pay anyway to forge yourself.
To: Kong Ming Sent: December 28 2006 8:07 PM EST Delivered: 4:25 AM EST
i require 353,624 for the blacksmith fees, or i will not be able to forge your item.
To: Kong Ming Sent: December 28 2006 5:32 PM EST Delivered: December 28 2006 5:53 PM EST
are you going to send me the item??

Flames Fame December 29 2006 1:02 PM EST

<Kong_Ming> ok, before we can start the deal, I noticed you don't have much money. How are you going to pay the blacksmith fees? My BoTH is +44 now and I want the + to be forged only. I expect about 2.28 million nw increase for my AGs.

This was the original deal, first he wanted 1.6 M done for his ag's now he wants 2.28M then 2.79M whats the deal??

AdminShade December 29 2006 1:07 PM EST

in my honest opinion, your terms and conditions aren't too clear apparently, but I'll try:

Facts:
You are forging for Kong Ming for 20% of NW + an additional amount (which isn't specified)

He pays you with $353,000 + his Alatar's Gloves (with a worth of $1,600,000) which amount to a total of $1,953,000

The NW increase on the Mage Shield is about $1,800,000

He tells the public that you should be forging for another $1,000,000 on another item, the total amount of NW forged is then $2,800,000.

This makes you for $1,953,000 / $2,800,000 * 100% = 69.75%

Now my reasoning:
You asked to have 20% up front, which is the $353,000 apparently, this especially because he is paying with an item, which you agreed upon and he can't send 20% of that...

You shouldn't have confirmed it in the first place if the '20% down' wasn't covered.

My honest opinion:
If you break the deal as it is now, you are the cheater. He pays you in goods (the item) and agreed on also paying 20% up front. If you didn't want to receive the 20% up front, because he is already paying in form of the item, then you should have specified this in the deal instead of being angry about it now.

Flames Fame December 29 2006 1:13 PM EST

I am not angry, i'm upset that he wants me to forge 2.79M for an item that he originally wanted 1.8M done for. This is where i am confused... I am agreeing to forge off the 353K at 353K but not 990K, so adding 990K to the 1.8M in my opinion is improper... this is pretty much a loan of 353K which i would be paying back by forging it off. I am not going to forge 990K for an amount of 353K loaned which is about 280% that is totally improper.

AdminShade December 29 2006 1:19 PM EST

Forging $1,800,000 at what I see to be 70% would make him pay you $1,260,000.

He pays more (being at least $1,600,000 and probably also plus $353,000) so how will you compensate for that?

Flames Fame December 29 2006 1:32 PM EST

2,790,000 *.70% = 1,953,000 1.6 for the AGs and 353K for the BS Fees... I do apologize for all of this, i was confused.

Good that it is cleared up now then :)

Next time, don't forget about your own rule:

4. This contract is binding on all parties; posts will be made in PR and YOU must REPLY saying you agree to the contract terms and agreements.

Using a PR thread, YOU get to write up the agreements, which the other party has to agree on. That will make interpretation of agreements a lot easier for yourself, the other party, and in case things go wrong, for Bart and Shade.

Flames Fame December 29 2006 7:26 PM EST

Thanks, and i do apologize for all the trouble. I will make a new post tonight In Forging that takes over my other and is more clear and readable for everyone.

Kong Ming December 29 2006 11:24 PM EST

No problems on my side. :) Good that everything has been cleared up.
