Can I hire a minion and keep that char in the clan if that hiring would put us over the limit?

Yes, once a character it in, it be in.
The only thing that will change is the bonus or negative you get to clan points.
Of course you can. Clan limit only affects the amount of CPs you gain and when you are trying to switch a new char into the clan.
